Before proceeding with our services, we kindly request that you carefully review these Terms. By engaging our services, you acknowledge and agree to comply with the terms and conditions outlined herein.
Our commitment to excellence, coupled with our dedication to customer satisfaction, forms the cornerstone of our business practices. We strive to ensure a seamless and efficient process in delivering exceptional packaging printing solutions to our clients.
These Terms cover various aspects of our services, including but not limited to order processing, design approval, payment terms, production, delivery, quality assurance, intellectual property rights, liabilities, and dispute resolution. It is essential to understand and adhere to these terms for a mutually beneficial business relationship.

Services Offered

Custom Packaging Design:
We offer custom packaging design services tailored to meet the unique branding and product requirements of our clients. This includes conceptualization, graphic design, and layout creation.
Printing and Production:
Our printing and production services cover the manufacturing of custom packaging materials based on approved designs. This includes various printing techniques, such as offset, digital, or flexographic printing, and production processes such as cutting, shaping, and finishing.
Material Selection and Consultation:
We assist clients in selecting suitable materials for their packaging needs, considering factors such as durability, eco-friendliness, and aesthetic appeal.
Consultation and Support:
We offer consultation and support throughout the design and production phases, assisting clients in making informed decisions regarding design elements, materials, and production techniques.
After-Sales Support:
Our commitment extends beyond production, offering ongoing customer service and support to address any post-production queries, concerns, or additional service requirements.

Ordering Process

Quotation and Payment Terms:
Clients may initiate quote by submitting detailed specifications, including design files, dimensions, material preferences, quantities, and any specific instructions through our designated channels (email, online portal, etc.).
AutumnHomeForever will provide a detailed quotation outlining pricing, including material costs, production charges, shipping fees, and any applicable taxes. Payment terms, including deposit requirements, payment methods, and due dates, will be specified.
Order Confirmation:
Order is confirmed upon receipt of the order confirmation and any required initial payments. Design work will be started after payment is received.
Design Confirmation and Approval:
Upon receipt of design files and specifications, AutumnHomeForever will review the materials and confirm their suitability for production. We may provide design proofs or samples for client review and approval before production commences.
Requests for design alterations or revisions after order confirmation may be accommodated within reasonable limits. However, additional charges or revised timelines may apply and will be communicated to the client for approval.
Production Commencement:
Production will commence upon the design is confirmed. The timeline for production will be communicated based on the agreed-upon schedule, subject to factors such as design complexity and material availability.
Quality Control and Inspection:
Throughout the production process, AutumnHomeForever will conduct quality control checks to ensure adherence to design specifications and industry standards. Finished products will be inspected before shipment to guarantee quality.
Delivery and Acceptance:
Upon completion, the finished cosmetics packaging will be prepared for delivery to the client's specified address. Clients are responsible for accepting the delivery within the agreed-upon timeframe and inspecting the received items for any discrepancies or damages.
Claims and Disputes:
In the event of any discrepancies, damages, or disputes regarding the received packaging materials, clients are required to notify AutumnHomeForever promptly. The process for handling claims and resolving disputes will be as outlined in the terms and conditions.

AutumnHomeForever reserves the right to modify, amend, or update these terms and conditions at any time without prior notice. The updated terms shall become effective upon posting on Autumn Home Forever Company's Website.

Intellectual Property Rights

Client's Intellectual Property:
Any intellectual property provided by the client, including but not limited to logos, designs, artwork, trademarks, or any proprietary materials, remains the sole property of the client.
Ownership of Created Designs:
Designs, concepts, or creative works developed by AutumnHomeForevere during the course of providing services shall remain the intellectual property of AutumnHomeForever unless otherwise agreed upon in writing.
Usage Rights:
Upon full payment and completion of the services provided by AutumnHomeForever, the client will be granted a non-exclusive, non-transferable license to use the finalized designs solely for the intended purpose of packaging printing and related marketing of their products.
Prohibited Usage:
The client is prohibited from sublicensing, reselling, or transferring the licensed designs to third parties without prior written consent from AutumnHomeForever.
Confidentiality and Non-Disclosure:
AutumnHomeForever agrees not to disclose any confidential information or trade secrets provided by the client for the purpose of the project. Similarly, the client agrees to keep any proprietary information from AutumnHomeForever confidential.
Indemnification:
The client shall indemnify and hold harmless AutumnHomeForever from any claims, liabilities, or legal actions arising from the use of any intellectual property provided by the client, including claims of infringement or unauthorized use.
Modifications and Derivative Works:
Any modifications, alterations, or derivative works created based on the licensed designs shall be considered the property of AutumnHomeForever unless otherwise agreed upon in writing.
Rights to Display Work:
AutumnHomeForever retains the right to display the completed work in portfolios, websites, or marketing materials for promotional purposes, unless otherwise specified in writing by the client.
Termination of Services:
In the event of termination of services, the rights and licenses granted to the client for the use of the designs will cease, and any further use shall be prohibited.

Liability and Indemnification

Limitation of Liability:
AutumnHomeForever shall not be liable for any indirect, consequential, or incidental damages arising from the use or inability to use the printed packaging materials, including but not limited to loss of profits, business interruption, or any economic losses.
Responsibility for Provided Content:
The client assumes full responsibility for the accuracy, legality, and appropriateness of the content, designs, and materials provided for printing. AutumnHomeForever shall not be held liable for any infringement of copyrights, trademarks, or other intellectual property rights associated with the provided content.
Quality Assurance:
While AutumnHomeForever ensures stringent quality control measures, including inspections and adherence to industry standards, the client acknowledges that slight variations or discrepancies may occur in the printing process.AutumnHomeForever shall not be liable for minor variations that do not significantly deviate from approved samples or proofs.
Indemnification by Client:
The client agrees to indemnify, defend, and hold harmless AutumnHomeForever, its employees, agents, and affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising from:
a. Any breach of the terms and conditions outlined herein.
b. Infringement of intellectual property rights related to provided content or materials.
c. Misrepresentation or violation of third-party rights associated with the printed materials.
Claims and Notice:
In the event of any claims, disputes, or legal actions arising from the printed materials, the client agrees to promptly notify AutumnHomeForever in writing and cooperate in the defense or settlement of such claims. To initiate a claim, the customer must provide detailed information, including order number, description of the issue, and supporting evidence (photographs, videos, etc.).
a) Instructions for Return Packaging: Clients must follow the instructions provided by AutumnHomForever for the proper return of packaging. This may include packaging materials, labels, or any other elements associated with the original shipment.
b) Return Window: Clients are required to initiate the return of packaging within 7 days from the initiation of the claim process, unless otherwise specified in writing by AutumnHomeForever.
c) Verification Process: The return packaging will be subject to verification by AutumnHomeForever to ascertain its condition and authenticity.
d) Conditions for Approval: AutumnHomeForever reserves the right to deny a claim if the return packaging is not received within the specified timeframe or if it does not meet the required conditions.
e) Refund or Replacement Based on Packaging: The resolution of the claim, including any refund or replacement, will be contingent upon the satisfactory return of packaging and the verification process.
Limitation of Claims Period:
Any claims, disputes, or legal actions arising from the printing services provided by AutumnHomeForever must be filed within 7 Days from the delivery date of the printed materials; otherwise, they shall be deemed waived.
Exclusion of Liability for Force Majeure:
AutumnHomeForever shall not be held liable for any delay, failure, or inability to perform its obligations due to circumstances beyond its reasonable control, including but not limited to acts of nature, strikes, or governmental actions.
Rights to Display Work:
AutumnHomeForever retains the right to display the completed work in portfolios, websites, or marketing materials for promotional purposes, unless otherwise specified in writing by the client.
Extent of Liability:
AutumnHomeForever's liability under any circumstances shall be limited to the total amount paid by the client for the specific printing services provided.

Termination of Agreement, Cancellation, and Refund Policy

Termination by Either Party:
Either party (the client or AutumnHomeForever may terminate the agreement upon providing written notice to the other party in accordance with the terms specified herein.
Client's Right to Cancel:
The client may request order cancellation before the commencement of production by providing written notice. Any cancellations after production has commenced may be subject to charges or fees based on the incurred expenses up to that point.
Cancellation Fees or Charges:
In case of order cancellation, AutumnHomeForever reserves the right to apply cancellation fees or charges to cover costs incurred up to the cancellation date. These fees shall be communicated to the client upon cancellation request.
Refund Policy:
Refunds, if applicable, shall be processed based on the following conditions:
a. Full or partial refunds may be considered for cancellations made before the commencement of production, subject to deduction of any incurred expenses or non-refundable deposits.
b. No refunds shall be provided for cancellations made after production has commenced or for completed orders, except in cases where AutumnHomeForever fails to deliver according to agreed specifications.
Failure to Pay:
Failure by the client to make timely payments or fulfill financial obligations as per the agreed terms may result in order suspension, termination, or withholding of further services until payment is received.
Termination Due to Breach:
AutumnHomeForever reserves the right to terminate the agreement in the event of a material breach by the client, including but not limited to non-payment, violation of intellectual property rights, or non-compliance with the terms outlined herein.
Process for Termination:
Upon termination, both parties shall fulfill any outstanding obligations, return or destroy any proprietary materials, and settle any outstanding payments in accordance with the terms specified in the agreement.
Survival of Terms:
The termination of the agreement shall not affect the survival of clauses related to intellectual property rights, indemnification, confidentiality, and any other terms intended to survive termination.

Governing Law and Dispute Resolution

Governing Law:
This agreement shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or related to this agreement shall be governed by Malaysian law.
Dispute Resolution:
In the event of any disputes or disagreements arising from this agreement, both parties agree to seek resolution through good faith negotiations and discussions.
Mediation:
Should any dispute arise between the parties, both parties agree to attempt to resolve the dispute through mediation administered by a mutually agreed-upon mediator in Malaysia, before pursuing other legal remedies.
Arbitration:
If mediation fails to resolve the dispute within a reasonable timeframe, both parties agree to submit the dispute to binding arbitration in accordance with the rules of the Malaysian Arbitration Act. The arbitration shall be conducted in Kuala Lumpur, Malaysia.
Costs of Dispute Resolution:
The costs and expenses associated with mediation, arbitration, or any dispute resolution proceedings, including legal fees and arbitrators' fees, shall be borne equally by both parties unless otherwise determined by the arbitration tribunal.
